01Acceptance
Cloner is operated by Symmerce LLC, a Wyoming limited liability company. By creating a Cloner account or using the service, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use Cloner.
02Definitions
- Service means Cloner and any related websites, APIs, and applications.
- User, you means the individual or entity that has accepted these terms.
- Content means any material you submit, including URLs and prompts.
- Clone Artifact means the code, markup, assets, or other output generated by the Service from your Content.
- Subscription means a paid plan with recurring billing.
03Eligibility
You must be at least 18 years old and have the legal capacity to enter a binding contract. If you use Cloner on behalf of an organization, you represent that you have authority to bind that organization to these terms.
04Accounts & security
You are responsible for keeping your credentials confidential and for all activity that occurs under your account. Notify us immediately at support@trycloner.com if you believe your account has been compromised.
05Subscriptions & billing
Subscription tiers and prices are published on our pricing page. Paid subscriptions renew automatically at the end of each billing cycle until you cancel. Taxes may apply based on your billing address.
Upgrades take effect immediately and are prorated. Downgrades take effect at the end of the current billing cycle.
06Refund policy
Except where required by law, subscription fees are non-refundable. If you believe you have been billed in error, email support within 14 days and we will investigate.
07Acceptable use
You agree not to:
- Use Cloner to create content that is illegal, infringing, or deceptive.
- Clone websites you do not have the legal right to copy.
- Bypass authentication walls or scrape private or paywalled content belonging to others.
- Ignore
robots.txt, rate limits, or other mechanisms a site uses to control access. - Reverse-engineer, resell, or build a competing product on top of the Service.
- Attempt to disrupt or overload the Service, or probe it for vulnerabilities without authorization.
08Cloned URLs & your responsibility
You are responsible for the URLs you submit. By submitting a URL, you warrant that you have the legal right to clone that site — for example, because you own it, have a license from the owner, or it is clearly released under terms that permit copying.
You agree to indemnify and hold Cloner harmless against any claim brought by a third-party site owner arising out of your use of the Service to clone their site, including claims for copyright, trademark, trade dress, or terms-of-service violations.
09User content & clone artifacts
You retain ownership of the URLs and prompts you submit and of the Clone Artifacts we generate for you. You grant Cloner a limited, non-exclusive, worldwide license to host, process, transmit, and display your Content and Clone Artifacts solely to operate and improve the Service for you.
10Cloner IP
The Service, including the Cloner name, logo, UI, documentation, and the code that powers the product, is owned by Cloner and protected by intellectual property laws. These terms do not grant you a license to the Cloner brand, and you agree not to use it except as permitted by applicable fair-use rules.
11AI & generated output
We do not train our models on your submissions or on the Clone Artifacts generated for you. AI-assisted output may contain errors or inaccuracies — review it before relying on it in production.
12Third-party sites
Cloned sites remain subject to the intellectual property rights and terms of service of their original owners. Nothing in these Terms transfers rights in a third-party site to you.
13Availability & beta features
We operate Cloner on a best-effort basis. There is no service-level agreement on the free tier. Beta or experimental features are provided “as is” and may be changed or removed without notice.
14Termination
You may close your account at any time from your settings. We may suspend or terminate your account if you violate these terms, if required by law, or to protect the Service and its users. We will give reasonable notice where practical.
15Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that Clone Artifacts will be accurate or complete.
16Limitation of liability
To the maximum extent permitted by law, Cloner's total liability for any claim arising from these Terms or your use of the Service is capped at the amount you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.
17General
Indemnification
You agree to indemnify Cloner against claims arising from your Content, your use of the Service, or your violation of these Terms.
Governing law
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-laws rules. Any dispute arising under these Terms will be brought exclusively in the state or federal courts located in Wyoming.
Changes
We may update these Terms as the Service evolves. Material changes will be announced at least 30 days in advance. Continued use after changes take effect constitutes acceptance.
